Terms of Service
Airfree Clouds Pty Ltd (ACN: 000 000 000) — Effective 1 July 2025
1. Agreement and eligibility
These Terms of Service (“Terms”) form a binding legal agreement between you and Airfree Clouds Pty Ltd (ACN: 000 000 000) (“Airfree Clouds”, “we”, “us”, or “our”), an authorised licensee of Airfree Services Pty Ltd. By creating an account, placing an order, or using any part of the platform, you agree to these Terms.
You must be at least 18 years old and legally capable of entering into a binding contract to use our services. If you are accepting these Terms on behalf of an organisation, you represent that you have authority to bind that organisation and that your acceptance constitutes acceptance by the organisation.
We may update these Terms from time to time. Material changes will be communicated by email at least 30 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.
2. Account security
You are responsible for maintaining the security and confidentiality of your account credentials. You must not share your password, use another person's credentials, or allow any third party to access your account.
You must notify us immediately at security@airfreeclouds.com if you suspect any unauthorised access to your account. We will not be liable for any loss or damage arising from unauthorised access resulting from your failure to maintain credential security.
We strongly recommend enabling two-factor authentication. Accounts with elevated privileges (resellers, API access) may be required to have two-factor authentication enabled as a condition of service.
3. Domain registration
3.1 ICANN policy compliance
All domain registrations are subject to ICANN's Registrar Accreditation Agreement (RAA), the applicable Registry Agreement, and ICANN Consensus Policies. By registering a domain, you agree to be bound by these policies, which may change from time to time without notice from us.
3.2 WHOIS accuracy
You represent that all registrant contact information you provide is accurate and complete. You must keep this information current throughout the life of the registration. Providing false or inaccurate WHOIS data may result in suspension or cancellation of your domain registration in accordance with ICANN policy.
3.3 EPP authorisation codes
An EPP authorisation code (also known as an auth code or transfer code) is required to transfer a domain to another registrar. We will provide this code upon request to the verified registrant. We may impose a 60-day lock on newly registered or recently transferred domains in accordance with ICANN policy.
3.4 Dispute resolution
Domain name disputes are subject to ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP) and, where applicable, the Uniform Rapid Suspension (URS) procedure. We will comply with orders issued under these processes and are not a party to UDRP proceedings between registrants and complainants.
4. Mail and Workspace
4.1 Acceptable use
Mail and Workspace services must be used in accordance with our Acceptable Use Policy, which is incorporated into these Terms by reference. Prohibited uses include sending unsolicited bulk email, distributing malware, and hosting illegal content.
4.2 Storage limits
Each plan includes a defined storage allocation per user. Where storage exceeds your plan limit, we will notify you and allow a 14-day grace period to reduce storage or upgrade your plan. If the excess is not resolved within 14 days, we may pause delivery of new messages until storage falls within your allocation. We will not delete messages without your explicit instruction.
4.3 Content responsibility
You are solely responsible for all content stored in or transmitted through Airfree Mail and Workspace. You must not store, transmit, or process content that violates any applicable law, infringes intellectual property rights, or constitutes illegal discrimination, harassment, or abuse.
5. Payment and renewal
5.1 Auto-renewal
Domains, mail plans, and workspace subscriptions automatically renew at the end of each billing period at the then-current renewal price unless you disable auto-renewal in your account settings at least 48 hours before the renewal date. We will send renewal reminder emails at 60 days, 30 days, and 7 days before each renewal.
5.2 Price changes
We may change subscription prices for mail and workspace plans. We will provide at least 30 days' written notice by email before any price increase takes effect. Continued use of the service after the notice period constitutes acceptance of the new price. Domain renewal prices are set by registry operators and may change without the 30-day notice period; we will display current renewal prices in your account dashboard.
5.3 Payment methods
We accept major credit and debit cards processed by Stripe. By providing a payment method you authorise us to charge it for all fees due under these Terms. Failed payments may result in service suspension after a 7-day grace period.
6. Refund policy
Mail and Workspace: you may request a full refund within 30 days of your initial subscription purchase. Refunds are not available for renewal payments or for partial billing periods.
Domain registrations: domain registrations are non-refundable once the registration has been processed by the registry operator (typically within minutes of payment). This reflects the fact that registry fees are non-recoverable. In exceptional circumstances (for example, duplicate registrations caused by a platform error), we may issue a credit at our discretion.
To request a refund, contact billing@airfreeclouds.com. Approved refunds are processed to the original payment method within 5–10 business days.
7. Suspension and termination
We may suspend or terminate your account immediately and without prior notice if:
- You breach these Terms or the Acceptable Use Policy
- Your account is used for spam, phishing, or distributing malware
- We are required to do so by law, court order, or ICANN policy
- Payment is overdue by more than 14 days after the grace period has passed
Where feasible, we will give you written notice and a reasonable opportunity to remedy the breach before suspension. For serious violations (for example, active malware distribution), suspension will be immediate.
You may terminate your account at any time from your account settings. Domain registrations will continue until their expiry date regardless of account closure; you should transfer domains to another registrar before closing your account if you wish to retain them.
8. Intellectual property rights
All intellectual property in the Airfree Clouds platform — including software, trademarks, logos, and documentation — is owned by or licensed to Airfree Services Pty Ltd. Airfree® is a registered trademark of Airfree Services Pty Ltd. Nothing in these Terms grants you any right to use Airfree trademarks or intellectual property other than as strictly necessary to access and use the services.
You retain all rights to content you store in Airfree Mail and Workspace. You grant us a limited licence to process your content solely to the extent necessary to provide the services.
9. Limitation of liability
To the maximum extent permitted by applicable law, Airfree Clouds' total liability to you for any claim arising from these Terms or your use of the platform (whether in contract, tort, or otherwise) will not exceed the greater of: (a) the total fees paid by you to Airfree Clouds in the 12 months immediately preceding the event giving rise to the claim; or (b) AUD $100.
We will not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or liability under the Australian Consumer Law.
10. Governing law
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the exclusive jurisdiction of the courts of New South Wales, and the Federal Court of Australia, for the resolution of disputes arising out of or in connection with these Terms.
11. Dispute resolution
Before commencing legal proceedings, both parties agree to attempt to resolve disputes informally. You must contact us at legal@airfreeclouds.com describing the dispute. We will respond within 10 business days. If the dispute is not resolved within 30 days of your initial notice, either party may refer the matter to mediation through the Australian Disputes Centre (ADC) before commencing court proceedings.
Nothing in this clause prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.
