Terms of Service

1. Agreement to terms

By creating an account or using Airfree Mail, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the service. These Terms form a binding agreement between you and Airfree Mail Pty Ltd (ACN 000 000 001) (“Airfree Mail”, “we”, “us”).

2. The service

Airfree Mail provides email, calendar, contacts, drive, and video communications services (“Service”) via the web, mobile apps, and standard email protocols (IMAP, SMTP, CalDAV, CardDAV). We may update the Service at any time and will notify you of significant changes.

3. Account registration

You must provide accurate information when creating an account. You are responsible for keeping your account credentials secure. You must not share your password or allow third parties to access your account. You must be at least 16 years of age to create an account.

4. Acceptable use

You agree not to use the Service to send unsolicited bulk email (spam), distribute malware, harass, threaten, or defraud others, violate any applicable law, infringe the intellectual property rights of others, or engage in any activity that disrupts or interferes with the Service. Full restrictions are set out in our Acceptable Use Policy.

5. Your content

You retain ownership of all emails, files, and data you store in the Service (“Your Content”). You grant us a limited, non-exclusive licence to host, store, and transmit Your Content solely to provide the Service to you. We do not use Your Content for advertising or share it with third parties except as required to deliver the Service or as required by law.

6. Pricing and payment

Free plan features are provided at no cost. Paid plans are billed monthly or annually in advance. Prices are listed on our Pricing page and are in USD unless otherwise stated. We may change prices with 30 days’ notice. If you do not accept a price change, you may cancel before the new price takes effect.

7. Cancellation and refunds

You may cancel your subscription at any time from account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods except where required by applicable consumer protection laws in your jurisdiction.

8. Service availability

We aim for 99.9% uptime. We will notify you of planned maintenance where possible. We are not liable for outages beyond our reasonable control. Paid plans are eligible for service credits if we fail to meet the uptime SLA set out in the applicable plan documentation.

9. Data and privacy

Our Privacy Policy explains how we collect, use, and protect your data. It forms part of these Terms. We do not read your email for advertising purposes.

10. Intellectual property

The Airfree Mail software, brand, and all related intellectual property are owned by Airfree Services Pty Ltd and licensed to Airfree Mail Pty Ltd. You may not copy, reverse-engineer, or create derivative works from the Service. Your Content remains yours.

11. Limitation of liability

To the maximum extent permitted by law, Airfree Mail is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account if you breach these Terms, engage in illegal activity, or fail to pay fees when due. We will give you reasonable notice where possible. You may export your data at any time before termination. On termination, we will delete your data within 30 days.

13. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. Any dispute shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
